San Diego Nursing Home Abuse Lawyer
Pressure Sores • Falls • Weight
Loss / Dehydration • Other
Injuries
If your loved one has been injured by neglect
or abuse in a nursing home
or care facility, I can
help you. I'm San Diego nursing home abuse
lawyer Joel R. Bryant, and
I have successfully handled
many cases in which elderly
victims have been seriously
injured or died in a California nursing
home due to:
- Pressure sores (bedsores or decubitus
ulcers).
- A fall causing a broken bone,
other serious injury, or death.
- Weight loss, malnutrition, and/or dehydration.
- Injury or accident resulting from inadequate supervision of
a confused or mentally impaired
elder, so that they wander
away or wander into danger
in the nursing home
- Intentional physical or sexual
abuse,
such as beating, rough handling,
or molesting.
- Any other neglect or harm causing
injury or death that the
nursing home could have prevented.
I offer a no-charge consultation and accept
Injury cases on contingency,
meaning my fees are paid only
from the money I recover
by settlement or in court; otherwise,
there is no fee. If
you need a California nursing
home abuse attorney, I can help
you. Please call me today at (619) 239-7900 for your no-charge
consultation.
Pressure Sores
I have successfully handled cases where elderly persons
have suffered serious pressure
sores, leading to pain,
infection, and even death. Pressure
sores (bedsores or decubitus
ulcers) are open sores on the
skin caused by constant pressure
of a bed or chair on the same
areas of the skin - typically,
on the hips, lower back, and
heels.
Pressure sores are caused
by poor nursing care: failure
to frequently turn and reposition
bedridden patients, and to limit
the time an elder spends sitting
if they cannot shift their
weight or get up
easily. Malnutrition and dehydration
will worsen pressure sores and
are additional signs of elder
abuse through neglect. If
your loved one has developed
pressure sores in
a nursing home or care facility, please
call me at (619)
239-7900, extension 113. I can help you.
Falls Causing Bone Breaks, Injury, Death
I have also recovered compensation for victims in cases
where an elderly person has
been seriously injured or even
died after falling in a nursing
home or care facility . A
fall may also signal nursing
home neglect by:
- Staff not helping a frail, confused, or medicated person
to walk
- Dangerous
conditions at the facility, such as wet floors,
poor lighting, lack of bed
rails, clutter, beds too
high
- Faulty or poorly chosen wheelchairs, walkers,
canes, shoes
- Poor technique in transferring elderly persons between beds
and chairs
- Restricted opportunities for walking
and other simple exercise,
so the elder person develops
muscle weakness that leads
to a fall
If your loved one has been seriously injured
or died because of a fall in
a nursing home, I can help you. Please
call me at (619) 239-7900 for
a no-charge consultation.
Weight Loss, Malnutrition and/or
Dehydration
I also handle cases where a nursing
home resident was injured or
died because they did not get
enough food, water, or help
in eating and drinking. This happens because of understaffing,
and/or failure of the staff
to pay attention to the nutritional
needs of the elderly patients,
and/or inadequate training
of the staff on nutritional
needs and feeding methods.
The result is that the elderly
person lacks the nutrition
needed to fight illness and
disease. They may lose weight,
develop pneumonia or bedsores, suffer
from infections, or even die.
If your loved one has lost weight
or become dehydrated, and their
health has then worsened or they
have died, I can help you. For more information
or a no-charge consultation,
please call me at (619) 239-7900.
Inadequate Supervision Resulting
in Wandering
With Injury or Death
A nursing home must provide adequate supervision
for a confused or mentally impaired
elder, so they do not wander
away from the home or encounter
a dangerous situation in
the nursing home. Accidents,
drowning, heatstroke, hypothermia,
falls, burns, and other injuries
may result from lack of supervision,
or from lack of safety precautions
such as alarms and door locks
at "secure"
facilities.
If your loved one was confused or mentally
impaired, and was seriously
injured or died as a result
of inadequate supervision in
a nursing home, please
call me for a no-charge consultation at (619) 239-7900, extension 113. I understand and have successfully
handled this type of case, and
I can help you.
Intentional Physical or Sexual Abuse
I also handle cases where nursing home staff or a stranger
(including a poorly-supervised
visitor or an intruder) has
intentionally used physical
force that injured an elder.
The law
forbids such physical abuse,
which includes hitting,
shoving, kicking,
being intentionally rough during
bed-to-chair transfers,
force-feeding causing choking,
and other similar conduct.
I also accept cases of sexual abuse of an
elder either by staff or by a stranger who
enters the facility due to
inadequate security. Sexual abuse is any unwanted sexual
conduct, including touching,
molesting, and rape.
Even if the elder person does
not complain due to shame,
fear, or confusion, they have
the right to be free of sexual
abuse. The nursing home can
be held legally responsible
if it failed to screen or supervise
abusive staff, or to provide
sufficient building security
to prevent entry by abusive
outsiders.
If you suspect physical or sexual abuse,
please call me at (619) 239-7900 for
a no-charge consultation. In
addition to advising you on
the victim's rights to compensation,
I will also advise you on how
to involve Adult Protective Services
and/or the police to immediately
stop the abuse.
Other Neglect or Harm Causing Serious
Injury or Death
I also handle other cases of serious injury
or death by an elder in a nursing home or other care
facility. If you have any questions,
please just call me at (619) 239-7900 for a no-charge
consultation.
How I Can Help You in a Nursing
Home Abuse Case
Many claims or nursing home abuse are due
to under-staffing and the desire
to maximize profit at the expense
of the quality patient care
promised. I have extensive
experience in handling elder
abuse cases and will diligently
and aggressively seek to obtain
compensation for the victim
(or their heirs, if the victim
has died) and hold the wrongdoers
responsible for their misconduct.
When you retain me for a nursing
home abuse case, you receive:
- My personal handling of your case, with sixteen years
of legal experience,
and a track
record of success in nursing
home injury compensation.
- A no-charge initial telephone consultation.
- Fees paid only from the
money I recover in court or
by settlement.
- A complete
explanation of my services,
fees, and related costs (such as court filing
fees) in a written agreement for
you to review and sign before
you hire me.
- Meetings as needed at
my firm's freeway-accessible
offices in San Diego or Riverside,
or other convenient
location. I also
offer evening and weekend
appointments for clients
who need them.
- Prompt and
thorough factual and legal
rights investigation to
determine the nature and
extent of the elder person's
injuries, what caused the
injuries, who is responsible,
and the potential for recovering
compensation.
- Critical
evaluation of the conduct
of the nursing home, its staff,
and the conduct of the
company that owns or manages
the nursing home.
- Thorough preparation and aggressive
representation at all stages
of litigation, including
trial or settlement and appeal.
- I guarantee the high quality
of my work and my dedication
to fighting hard and to seeking
the best possible outcome
for the victim (or their
heirs),
given the applicable law and
facts.
I handle cases throughout all
of Southern California, including
the counties of San Diego, Riverside,
Imperial, Orange, Los Angeles,
Ventura, and San Bernardino.
I look forward to discussing
your case with you and would
be glad to provide you with any
additional information about
my services you need.
